These Terms & Conditions apply when you use southernunitedseafood.com.au or buy from Southern United Seafood Australia Limited (ABN 61 071 463 968, ACN 071 463 968), trading as 義友海鮮 ("Southern United Seafood", "we", "us", "our").

By using our website, placing an order or requesting a quote, you agree to these Terms. Nothing in them excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (ACL) or any other law that can't lawfully be excluded. If these Terms conflict with those laws, the law prevails.

1. About us

We are a seafood supplier based in Richmond, Melbourne, serving individual and business customers since 1995. Our contact details are in section 27.

2. Using our website

You may use our website to browse, buy, make enquiries and request quotes. You must not:

  • use it for anything unlawful or fraudulent
  • interfere with its operation or security, or try to access its systems without permission
  • copy or commercially use our content without permission
  • give false or misleading information when ordering or enquiring.

We may restrict or suspend access where reasonably necessary to protect our business, customers or systems.

3. Product information and photos

We work to keep product descriptions, photos, weights, origins and availability accurate.

Seafood is a natural product, so size, colour, shape and weight can vary. Photos show a typical example and are a guide only unless we say otherwise. Packaging may change from time to time.

Where a description states a species, origin, size, grade or preparation, we will supply the product to match that description.

Availability can change because of season, weather, fishing conditions, supply and regulation.

4. Products sold by weight

  • Where a product is listed with a minimum weight (for example "min. 500g"), we will supply at least that weight.
  • Where a product is listed with an approximate weight, the actual weight may differ slightly.
  • If a final price can only be set once a product is weighed, we will tell you before your order is finalised. We will never charge more than the amount you authorised at checkout without your agreement.

5. Live seafood

Live seafood is sold by enquiry and quotation only and can't be bought through our online checkout. Items marked "Price on request" are quote-only.

Your quote will confirm price, size, quantity and collection arrangements. Unless we agree otherwise in writing, live seafood is available for collection only from our Richmond store.

Live seafood is highly perishable, and availability can change at short notice. Any condition or live-arrival commitment we make will be set out in your quote.

6. Orders

Placing an order is an offer to buy. Our automatic confirmation email only acknowledges that we received your order. We accept your order when we dispatch it or confirm it is ready for collection.

We may decline or cancel an order before it is fulfilled if:

  • the product is unavailable or out of stock
  • we can't deliver to your address (we only deliver within Victoria)
  • payment hasn't gone through
  • we reasonably suspect fraud
  • a product was listed at an obviously incorrect price (including $0.00) or with another clear error
  • fulfilling it would breach the law.

If we cancel an order you've paid for and we haven't agreed an alternative with you, we will refund you in full to your original payment method.

7. Prices

Online prices are in Australian dollars and include GST where applicable. Delivery charges are shown at checkout before you pay.

Prices may change, but changes won't affect an order we have already accepted.

Where a bundle shows an "If bought separately" price, that figure is the total of the current individual prices of the items in the bundle.

Business and quoted prices may differ from our online prices.

8. Payment

Pay using a method offered at checkout or otherwise agreed with us. By paying, you confirm you're authorised to use that payment method.

We won't process or dispatch an order until payment is authorised, unless you have an approved business account with us.

Payments are processed by third-party providers under their own terms and privacy policies.

9. Promotions and discount codes

Unless a promotion states otherwise:

  • offers can't be exchanged for cash
  • only one discount code can be used per order
  • codes must be entered before checkout is completed
  • offers are only available during the stated period and while stocks last.

Current offers:

  • Welcome offer: $10 off a first online order over $100 [excluding delivery]. New email subscribers only. One use per customer. [Can / cannot] be used with bundle prices.
  • Mid-Autumn Gift Bundles: available until [END DATE] or while stocks last.

10. Delivery

  • We deliver anywhere in Victoria, including regional areas. We don't deliver outside Victoria.
  • Live and frozen products are available for collection only. Delivery is offered at checkout only for products we can deliver.
  • We aim to dispatch within 1 business day of payment, and delivery usually takes 2-3 business days after that. Regional areas may take longer. These timeframes are estimates unless we expressly guarantee a date.
  • Business days exclude weekends and Victorian public holidays. Please order early before festivals and public holidays.
  • You'll receive tracking details once your order is dispatched.
  • Signature on delivery: all deliveries require a signature. The carrier can't leave your order unattended, and we can't waive this requirement.
  • Please give an accurate address, and make sure someone is available to sign for your order.
  • If no one is available: the carrier will leave a card or notification explaining how to collect your order. Please collect it within the carrier's holding period.
  • If your order is returned to us: we'll contact you. You can:
    • collect it from our Richmond store at no extra cost
    • pay [a redelivery fee] for us to send it again
    • cancel it for a refund, less the original delivery charge [and any return postage].
  • Responsibility for the products passes to you once they are signed for or collected. Ownership passes once we receive full payment.

11. Collection

  • Collect your order from 26 Baker Street, Richmond VIC 3121, at the agreed time and within our opening hours.
  • We hold orders for [2] business days after the agreed collection time.
  • If you can't make it, contact us as soon as possible so we can try to rearrange.
  • If an order isn't collected within that time and we can't reach you, we may cancel it. We will refund you, less the cost of any perishable products we can no longer sell.

12. Storage, handling and allergens (first bullet changed)

  • Store and prepare products according to the instructions on the pack or product page. Refrigerate or freeze chilled and frozen products as soon as you collect them, and follow the pack's instructions once a pouch or can is opened.
  • Once you've received products in good condition, you're responsible for storing and handling them safely.
  • Our range includes products that contain or may contain allergens, including molluscs, crustaceans, wheat (gluten) and sulphites. Check the allergen statement on the product page and pack before eating. If you have a food allergy or dietary need, contact us before buying.

13. Cancellations and change of mind

Because most of our products are perishable or prepared for your order, we don't offer refunds or returns just because you've changed your mind.

If you need to change or cancel an order, contact us as soon as possible. If we haven't started preparing, sourcing or dispatching it, we may agree to the change.

This doesn't affect your rights if a product is faulty, unsafe or not as described.

14. Problems with your order

Please contact us if a product:

  • arrives damaged or spoiled
  • is unsafe
  • isn't what you ordered or doesn't match its description.

For perishable products, we ask that you tell us, preferably within 24 hours of delivery or collection, so we can investigate properly. We may ask for photos, your order number and the packaging. This request doesn't limit your rights under the ACL.

15. Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

16. Business customers

Business orders may be covered by separate quotes, account terms, credit terms or supply agreements. Where these apply, they sit alongside these Terms and take priority if the two conflict. Nothing here excludes ACL protections that apply to business customers.

17. Unavailable products and substitutions

If something you ordered becomes unavailable, we'll contact you to offer one of:

  • an alternative product
  • a different size, grade or quantity
  • a later date
  • a refund for that item.

We won't substitute a materially different product without your agreement.

18. Website content

We try to keep our website accurate and current, and we correct errors when we find them. This doesn't let us avoid our obligations under an accepted order or the law.

19. Intellectual property

Our branding, logos, photos, text, designs and other website content are owned by or licensed to Southern United Seafood. You may use our website for personal or genuine business purchasing only. You must not copy, publish, modify or commercially use our content without our written permission, except where the law allows.

20. Third-party websites and services

Our website may link to third-party sites and services, including payment and delivery providers. We don't control them and aren't responsible for their content, security or privacy practices. Their own terms may apply.

21. Liability

To the extent permitted by law, we're not liable for loss or damage caused by:

  • use of our website contrary to these Terms
  • inaccurate information you gave us
  • improper storage, preparation or handling after delivery or collection
  • unauthorised use of our website
  • events outside our reasonable control.

This doesn't apply where the loss was caused by our negligence, our breach of the law, or our failure to meet an obligation that can't be excluded.

22. Events outside our control

Our supply or delivery can be affected by events outside our control, such as:

  • severe weather or natural disasters
  • transport disruption
  • fishing conditions or supply shortages
  • equipment failure
  • government restrictions.

If that happens, we'll take reasonable steps to limit the disruption and keep you informed. We'll also offer an alternative or a refund for the affected items.

23. Privacy

We handle your personal information in line with our [Privacy Policy] and applicable privacy laws.

24. Language

These Terms may be provided in English and Chinese. If the two versions differ, the English version applies.

25. Changes to these Terms

We may update these Terms from time to time. Changes take effect when published on this page. Your order is governed by the Terms in place when you placed it, unless a change is required by law or you agree to it.

26. General

  • If any part of these Terms is invalid or unenforceable, only that part is limited or removed, and the rest still applies.
  • If we don't enforce a right straight away, we haven't waived it.
  • These Terms are governed by the laws of Victoria. You and we submit to the courts and tribunals of Victoria, subject to any right you have to bring proceedings elsewhere.
